Sr Counsel Privacy & AI
Apply for RoleSenior Corporate Counsel – Privacy & AI is a senior individual contributor providing specialized legal expertise at the intersection of employment law,data privacy, data protection, and artificial intelligence. This role acts as a subject matter expert with a remit for all business units in the NAM region, collaborating closely with global and local legal teams, as well as HR and business functions. The position bridges global strategy and local execution, ensuring harmonized risk management and governance, and provides subject matter expertise for all Data Privacy, AI, Digital Law, and employment-related queries in the region, with particular emphasis on the unique legal challenges facing workforce solutions providers.
What you’ll be doing- Act as liaison between Group and local legal teams, ensuring the global Privacy Program and AI & Digital strategy and activities are implemented in NAM, with particular attention to employment-related data processing activities.
- Ensure regional/country adaptation and rollout of global privacy policies, standard operating procedures, and standards, including those specific to employee and candidate data handling.
- Conduct legal analysis for AI use cases impacting the employment lifecycle – including recruitment, hiring, performance management, and workforce scheduling – , as well as deployment and vendor onboarding, including privacy and AI due diligence, reviewing AI systems for compliance with emerging AI regulations (EU AI Act, state AI laws), and assessing algorithmic bias, disparate impact, and fairness risks under Title VII and state employment discrimination laws.
- Advise on employment-related adjacent privacy matters, including biometric data compliance (BIPA and state biometric laws), workplace monitoring and employee surveillance tools, wage and hour timekeeping systems, background check and Fair Credit Reporting Act (FCRA) privacy requirements, and cross-border data transfers for international staffing operations involving employee records.
- Advise business stakeholders on data privacy and AI legal risk and mitigation strategies in the employment context, including lawful bases for processing employee and candidate data, data subject rights (including employee access and deletion requests), cross-border data transfers of personnel records, PIAs/DPIAs for HR technologies, AI ethics and responsible AI principles in workforce management, and algorithmic transparency requirements for automated employment decisions.
- Conduct required assessments of applications, websites, systems and AI tools from a data privacy standpoint, with emphasis on HR technology platforms, applicant tracking systems, and workforce management tools; assess third-party supplier maturity and provide recommendations.
- Conduct Data Privacy and AI awareness and training initiatives; onboard and train local privacy ambassadors and maintain close collaboration with them.
- Handle data incidents and breaches involving employee, candidate, or contingent worker data in close collaboration with local legal teams and IT security, and liaise with local data protection authorities where necessary, unless the issue is group-wide where escalation to the Group DPO is required.
- Monitor, ensure registration and notification to local regulators as required by local laws; monitor regulatory changes on Data Privacy, AI and digital law in the region.
- Facilitate the execution of legal mechanisms and ensure compliance of cross-border data transfers, including by conducting transfer impact assessments
- Partner with employment counsel on joint worker classification, co-employment, and contingent workforce matters that have data privacy or AI implications, including advising on data sharing arrangements with clients and managed service providers.
- Carry out periodic reviews to check accuracy of data inventory (RoPA); assist with internal controls and audits to ensure privacy compliance.
- Manage outside counsel on assigned matters, including selecting and retaining counsel within approved panel firms, defining scope of engagement, reviewing and approving work product, monitoring adherence to billing guidelines and budgets, and ensuring strategic alignment with internal legal objectives.
- Manage privacy and AI regulatory matters, investigations, or enforcement actions, including data protection authority inquiries, data breach response and notification, privacy-related litigation, regulatory audits, EEOC charges involving AI hiring tools, and FTC, state attorney general, and international DPA complaints.
- Juris Doctor (J.D.) and active license to practice law.
- 6–8+ years legal experience with a demonstrated focus on employment law,data privacy, data protection, and/or artificial intelligence law, including experience advising on GDPR, CCPA/CPRA, or other comprehensive privacy frameworks, employment privacy laws (FCRA, BIPA, state biometric laws) and familiarity with emerging AI regulatory developments affecting the workplace.
- Proven ability to operate independently on complex matters, including a track record of managing multiple concurrent matters with minimal supervision, exercising sound legal judgment under time pressure, and delivering practical, business‑oriented legal advice.
- Experience in the staffing, workforce solutions, or human capital industry strongly preferred, including familiarity with the unique data flows and regulatory requirements applicable to temporary and contingent workforce arrangements.
- Knowledge of AI hiring employment regulations, including NYC Local Law 144, Illinois AI Video Interview Act, EEOC guidance on AI in employment, ADA implications of AI accommodation tools, and emerging state and federal AI legislation affecting hiring, workforce management, and employee monitoring.
- Familiarity with employment law fundamentals, including wage and hour regulations, worker classification, anti-discrimination laws, and leave/accommodation requirements, as they intersect with data privacy and AI compliance.

The anticipated annual base salary range for this position is $132,067 - $242,124. Compensation varies based on a variety of factors including, but not limited to, experience, education, key skills, and geographic location. In addition to base salary, the position is also eligible for incentive compensation based on achievements outlined in the compensation plan.
Benefit offerings for full-time employment include medical, dental, vision, term life and AD&D insurance, short-term and long-term disability, additional voluntary benefits, commuter benefits, wellness plans, and a 401k plan or a non-qualified deferred compensation plan. Available paid leave includes Personal Time Off (PTO) on an accrual basis up to 152 hours a year, 10 Paid Holidays, 1 Community Service Day, and up to 6 weeks of Paid Parental Leave. PTO and holiday hours are prorated based on hire date within the calendar year.
